If you are currently a party to a formal purchase agreement with Snap-on or any of its affiliates, the terms of that agreement will supersede any terms of this Site to the extent inconsistent.
USER IDS AND PASSWORDS
You will be solely responsible for the maintenance and security of your login identifier and password. Your login identifier and password are unique to you, and you agree not to disclose or share your login identifier and password with any third party. Snap-on reserves the right to deny or revoke access to this Site, or any part thereof, at any time in our sole discretion, with or without cause. Your access to this Site will terminate upon the termination of this Agreement for any reason.
DISCLAIMER
The wheel alignment specifications contained in the database downloads from this website are based on the latest information available from the car manufacturers at the time of publication. We reserve the right to change the specifications at any time without notice.
The inability to set toe or align the vehicle to the correct manufacturers specifications may indicate an axle or wheel assembly problem. I f you are unable to align a vehicle to the pre-programmed data, check specifications to the manufacturers data before renewing suspension or steering components.
ARBITRATION
Licensor and Licensee agree that any dispute, controversy or claim arising under, out of or relating to this Agreement and any subsequent amendments to it, including without limitation, its formation, validity, binding effect, interpretation, performance, breach or termination, as well as non-contractual claims, shall be resolved by alternative dispute resolution, the format of which shall be mutually agreed. The resolution process shall be commenced by written notice from one party to the other, identifying the nature of the dispute and requesting a dispute resolution proceeding.
If the parties are unable to agree on a format within 45 days after the request for a resolution proceeding, the dispute shall be referred to and finally determined by arbitration in accordance with the Arbitration Rules of the World Intellectual Property Organization (“WIPO”). The arbitral tribunal shall consist of a single arbiter. The place of arbitration shall be Chicago, Illinois, USA. The language to be used in the arbitral proceedings shall be English. The dispute, controversy or claim shall be decided in accordance with the law of the State of Wisconsin, USA. Licensor and Licensee agree that the decision of the arbiter shall be binding and enforceable in any court of competent jurisdiction.
WAIVER
No delay or omission by Snap-on to exercise any right occurring upon any non-compliance on your part with respect to any of the terms of this agreement will impair any such right or power or be construed to be a waiver thereof. Any waiver by Snap-on of any of the covenants, conditions or agreements to be performed by you will not be construed to be a waiver of any succeeding breach thereof or of any covenant, condition or agreement herein contained.
MODIFICATIONS TO TERMS AND CONDITIONS
Snap-on can revise these Terms and Conditions at any time by modifying or updating this posting. Your use of this Site on or after the effective date of any such modification or update will constitute your acceptance of these Terms and Conditions as modified and/or updated.
MISCELLANEOUS
If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. Any information related to your use of this Site for illegal purposes will be provided to law enforcement authorities. These Terms and Conditions and the Privacy Policy constitute the entire agreement between the parties relating to the use of this Site.
